Conditions of Use

1. GENERAL
  1. This Garage Geek website at [garagegeek.co.nz] (the “Site”) is a shopping website where you can browse, select, and order products from Garage Geek Limited (“Garage Geek”, “us” or “we”).
  2. The term ‘buyer’ refers to any legal entity purchasing from the seller.
  3. The buyer’s access to and use of the Site, including the buyer’s order of products through the Site, is governed by these Terms and Conditions.
  4. If the whole or any part of a provision of this agreement is void, unenforceable, or illegal in a jurisdiction, it is severed for that jurisdiction. The remainder of this agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy.
  5. This agreement is governed by the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the courts of that place.
  6. The customer agrees not to attempt to change, add to, remove, deface, hack, or otherwise interfere with this website or any material or content displayed on this website.
  1. The buyer agrees to be bound by, and comply with, these Terms and Conditions. In addition to these trading terms, there are Terms and Conditions that apply to the use of the Site. The buyer agrees to comply with the Terms of Use.
  2. The buyer agrees to comply with all relevant laws relating to their use of the Site and the placement of any order through the Site.
  1. The buyer may order products by selecting and submitting the order through the Site in accordance with these Terms and Conditions.
  2. Any order placed through this Site for a product is an offer by the buyer to purchase the product for the price notified (including delivery and other charges and taxes where applicable) at the time of placing the order. When the buyer places an order with Garage Geek, this constitutes an offer by the buyer to purchase those products in accordance with these Conditions of Use. The seller’s acceptance of the buyer’s order occurs (and the contract is formed) when the goods are dispatched to the buyer.
  3. The seller may request additional details or require the buyer to confirm their details to process any orders.
  4. The buyer agrees to provide current, complete, and accurate details when requested by the Site.
  1. In certain circumstances, we may need to reject your order. This may occur if the requested product is not available or if there is an error in the price or product description on the Site.
  2. Each accepted order results in a separate binding agreement for the supply of those products. For each accepted order, we will:
    • Supply the products in accordance with these Terms and Conditions; and
    • Provide you with an email confirmation of the order.
  3. If we reject an order, we will notify you at the time or within a reasonable time after you submit your order.
  1. If we determine a product is out of stock, we will use reasonable efforts for 30 days to source the relevant product (“Back Ordered Products”). We will notify you of any such items and the estimated delivery date.

  2. Delivery timeframes and processes are detailed on our Site.
  3. You agree to comply with our delivery requirements as set out at the time of placing your order.
  4. If you’ve paid by credit card, we recommend someone is present to receive the order.
  5. We may require the recipient to:
    • Provide proof of identity (including photo ID) and, if applicable, age;
    • Present the original payment card for verification, if paid by credit card.
  6. You agree that any person at the delivery address who receives the order is authorised by you to accept it.
  1. Risk and title to the products passes to you on delivery.
  1. You agree to pay the total purchase price of each product ordered.
  2. All prices are in New Zealand Dollars (NZD) and include GST where applicable.
  3. The price for each product is shown at the time you place your order. Online prices may differ from any physical retail prices and we are under no obligation to match them.
  4. Prices may change at any time without notice. However, we will not change the price for a product after accepting your order, subject to the Back Order Policy.
  5. If you cancel an order:
    • Subject to subclause (b), we will refund amounts paid by you for that order.

    • Credit cards: Visa, Visa Debit, MasterCard, AMEX
    • Bank deposit (via DPS Account2Account or similar)
    • Pay-in-4 solutions (e.g., Laybuy, Afterpay – if supported)
  2. If we are unable to process your credit card payment for an accepted order, we may cancel that order.
  3. By using a credit card, you authorise us to debit the amount due from your card.
  4. You must not use fraudulent or unlawful payment methods.
  5. All transactions are charged in NZD.
  6. Any currency converter shown on the Site is for reference only.
  1. You must inspect products for damage upon delivery. If damaged, refuse the delivery and notify us. If you discover damage after delivery, notify us within 30 days to arrange a return.
  2. For undamaged returns, refer to our [Returns Policy] which is incorporated into these Terms.
  3. A copy of the original invoice is required for all returns. If not provided, we may decline the refund.
  4. Delivery charges are non-refundable unless the return is due to damaged goods.
  1. Subject to clause 12.3, all implied terms and warranties are excluded to the fullest extent permitted by law. The Site is provided “as is” and we make no guarantees regarding product suitability or performance.
  2. Where a warranty cannot be excluded, our liability is limited to:
    • For services: resupply or reimbursement of cost;
    • For goods: replacement, equivalent supply, reimbursement of replacement cost, or repair cost.
  3. Our liability is reduced to the extent that your actions contributed to the loss or damage.
  4. Nothing in these Terms excludes liability that cannot be excluded by law.
  1. We may suspend, limit, or terminate your Site access if:
    • The breach cannot be remedied;
    • You fail to remedy a breach within 10 days of notice; or
    • There is an emergency or threat to the Site.
  2. We may cease offering the Site or services at any time. Existing accepted orders will still be fulfilled unless fulfilment is no longer possible, in which case you will be refunded.
  1. For future orders, these Terms may change. You should review them each time you order.
  2. For existing orders, the Terms in effect at the time of order will continue to apply.
  1. We respect your privacy. Personal information is collected and handled in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy.
  2. Information may be collected when you use the Site or contact us. You agree that we may use and disclose your personal information:
    • To provide our services and process transactions;
    • To third parties that assist with deliveries, fraud detection, and online shopping infrastructure;
    • For purposes to which you have consented.
